Asbestos Case Goes to Appeals Court

The asbestos case against San Diego Gas & Electric, as well as three employees, was ruled on this week. The ruling cleared all involved of conspiracy, but lawyers state they will appeal the decision.

Courts ruled this week that San Diego Gas & Electric, as well as two employees and a contractor, did not negligently dispose of asbestos at the Lemon Grove site in 2000. The case had been brought against the company, stating that, in order to save money and time, the amount of asbestos at the site was not disclosed to government regulators. SDG&E stated that the only asbestos at the site was piping insulation, which was a small enough amount to not have to be regulated by the government.

Prosecutors will bring the case to the court of appeals, hoping for a judgment on land that they say is still tainted with the hazardous material. The site was cleaned in order to sell it to a developer, which is considering building a park on the site. Prosecutors note the danger of asbestos exposure, which can result in respiratory illnesses including emphysema and a form of lung cancer known as mesothelioma. Mesothelioma occurs when asbestos fibers are breathed into the lungs and cannot be expelled. Authorities say there is no danger at the site, but plans will not move forward until the case is closed.
