Mining County Sees Less Asbestos Lawsuits

Madison County, Illinois had an uprising of asbestos lawsuits filed in the 1980s after it was found that victims were being exposed to the material. Lately, however, the number of lawsuits filed has dropped significantly.

The mining county of Madison in Illinois was the setting for an uprising of asbestos lawsuits starting in the 1980s. Some officials blame the lawyers involved, which contacted local unions in order to find victims of asbestos exposure. Regardless of the reasoning, the county saw almost 1,000 new asbestos lawsuits in 2003. New laws and a decrease in the mining industry have dropped these numbers over the past few years. The union president states that the new laws make it harder to file a suit in the county, accounting for the lower numbers.

The miners in the county came forward with respiratory illnesses including asbestosis. Some of the victims were showing early signs of emphysema and mesothelioma, a form of lung cancer affiliated with asbestos exposure. In the past few years, it was relatively easy to engage in an asbestos lawsuit as long as medical records of emphysema, asbestosis or mesothelioma could be proven after asbestos exposure. Diseases such as mesothelioma can take years to manifest, and if not caught early, can often be terminal.
