Asbestos Suit Judgment Overturned

The Supreme Court overturned a previous judgment that would make asbestos cases harder to resolve. The previous ruling was intended to ensure that no one state would become a focus for asbestos suits.

The state’s Supreme Court has overturned the wording of a judgment last year in Georgia this week. The original judgment stated that any person involved in an asbestos lawsuit in the state must provide evidence that asbestos was a “substantial contributing factor” to the victim’s condition. The Supreme Court removed the “substantial” part of the judgment, citing that the law would make it harder to resolve asbestos lawsuits. Over 800 cases in Fulton County, Georgia were on hold pending the decision by the higher court.

Many of the lawsuits that were on hold are against Georgia-Pacific Corporation, which produced materials containing the hazardous material. The victims suffer from many types of respiratory illnesses, including emphysema, asbestosis and a form of lung cancer called mesothelioma. Asbestos is not dangerous until it is broken apart, often while working with the material. Asbestos fibers can be breathed in and get stuck in the lungs, causing them to stop working effectively. Lawyers representing the victims said that the hold status of the cases would not clog the court, now that the Supreme Court ruling has been passed.
