Widow Wins Asbestos Lawsuit

An Illinois woman won a wrongful death suit regarding her husband, who dies from asbestos exposure. The suit claimed that the man was never informed of the dangers of working with asbestos.

The decline of John Hoogerwerf was quick; in 2001 he was diagnosed with mesothelioma, a form of lung cancer brought on by asbestos exposure. In the middle of 2002, he was dead. In cases of mesothelioma, the scenario is often the same. A person works with the hazardous material for years, then later in life they are diagnosed (and usually soon after die) with mesothelioma. Hoogerwerf’s widow sued Honeywell International, the company that employed her husband, as well as seven other companies.

The suit alleges that each of the companies withheld the fact that her husband was working with materials containing asbestos; she also states that once the situation was made apparent, the companies did not supply proper safety gear or training for the handling. A McLean County court awarded the estate of Hoogerwef more than $5 million in the suit, which Honeywell plans to appeal. All companies involved claim there was no conspiracy to keep information from their workers, and that new information was supplied as governmental groups distributed it.
