In an new mesothelioma case, the lawyers that once represented plaintiffs are being sued by the same people. They allege that in the class action suit, plaintiffs from the south were awarded more than those in the north.
Some southern asbestos lawyers are now on the receiving end of a lawsuit after their northern plaintiffs cried foul. In a group litigation process involving mesothelioma victims, the plaintiffs that were from the southern states of Mississippi, Texas and North Carolina were all awarded a larger portion of the $400 million decision. The northern victims, from Pennsylvania, Ohio and Indiana, said that deals were made without their knowledge involving local representation that entitled the southern victims to more of the compensation.
Mesothelioma cases, which involve victims suffering from the asbestos-related cancer, often involve dozens or hundreds of plaintiffs, which are normally entitled to equal compensation if the case is won. The northern plaintiffs are saying that the southern victims were given preferential payouts. A lower court decision threw out the suit earlier this year, claiming that there were no “damages” that the plaintiffs could sue over. A high court overruled the decision, stating that all partied involved in a suit should be entitled to proper compensation.
