Asbestos Violation Handed to Californian

California, and specifically Tracy County, is seeing more problems with asbestos. A man in Hayward has been indicted in a case that says he illegally demolished and dumped material containing asbestos.

The Clean Air Act was violated again in Tracy County, California and a Hayward man is paying the price. Four violations have been issued to the man that owns a building in Hayward that was demolished in 2003. The man is accused of not notifying the EPA and the local branch of the Air Quality Management regarding the demolition, which released harmful asbestos fibers into the air. Asbestos fibers can be deadly if inhaled, and demolition of a building containing asbestos requires supervision and special permits, which were not adhered to by the owner.

The asbestos was also improperly disposed, since the material was not kept in airtight containers. If asbestos is disturbed and becomes airborne it can be inhaled in the lungs. The fibers then become embedded in the tissue there, keeping it from absorbing oxygen. This form of cancer, known as mesothelioma, results in the surrounding tissue dying and the victim suffocating to death. The building owner maintains that he did nothing wrong and will appear in court in October.
