Asbestos Case may Turn Into Fraud Case

In an unexpected twist to a court case involving asbestos exposure and a transportation company, a West Virginia law firm has said that they plan to counter sue the plaintiffs for suspected fraud.

A lawsuit against CSX Transportation, alleging that the company exposed its employees to asbestos, has taken an interesting turn as the company’s lawyers have found evidence of fraud. The workers submitted medical records as evidence to the case against the company, but the files has since been found to be executed by a doctor not licensed in West Virginia at an address that cannot be found. Instead of throwing out the case, a Panhandle judge is allowing the company’s lawyers to investigate further.

CSX may now seek sanctions against the plaintiff possessing the records, although their lawyers are asking for information protection in a separate lawsuit against the company. The workers lawsuit includes 44 workers who claim that CSX did not inform them they were working in areas containing asbestos, which later led to health problems. The company may also choose to investigate the lawyers representing the man, stating that it is likely the lawyers knew the medical records were not valid, but submitted them as evidence regardless.
