Settlement Reached in CA Asbestos Case

A Monterey County construction company has settled with the county’s District Attorney in an asbestos case. The case alleged that the company mishandled and illegally disposed of the hazardous material.

A settlement has been reached between DMC Construction and the Monterey County DA’s office in regards to a case involving the mishandling and illegal dumping of asbestos. The suit came after it was found that the construction company did not disclose that they had disturbed asbestos at a site in Seaside, and then illegally dumped the asbestos in a local landfill.

The company has been ordered to pay more than $100,000 in fines, including penalties, training and re-licensing. The owner of the company was not held personally liable for any of the illegal activities, but was told that he would be responsible for the compliance issues going along with the settlement. The company will also be held responsible for the abatement of the landfill where the dumping took place. By dumping the asbestos in a public landfill, the company put the city’s residents in danger of asbestos exposure, which could have led to thousands of residents afflicted with respiratory ailments.
