A modern day David and Goliath match has ended with the smaller man coming out on top. The team was comprised of a 60-year-old man and a law firm that has only been open for three years.
In a surprise ruling, San Francisco’s Superior Court awarded a 60-year-old man more than $10 million in damages over his asbestos case. The ruling is a major victory for a law firm that has been open for a little more than three years. The ruling is also one of the 10 largest awards in California for a mesothelioma case in over 15 years. The man alleges that after working for 25 years as a ship fitter for Thorpe Insulation Co. he developed mesothelioma, a cancer that results from asbestos exposure.
Though the ruling is satisfying, the plaintiff will probably only see 15% of that award considering that the case only named Thorpe as a defendant. The company was found to be only 15% responsible for the man’s disease, along with being responsible for medical bills, which will result in the plaintiff receiving about $2.3 million of the award. The case is still making waves, though, due to the new firm having won a lawsuit for one plaintiff for that amount of compensation.
