Litigation for asbestos cases are starting to get tighter in restrictions. One insurance company, though, does not think that the current regulations for asbestos plaintiffs are strict enough.
A West Virginia insurance company is joining the fight in asbestos litigation. BrickSteet Insurance Co. has joined West Virginians for Fairness, a group of insurance companies, medical providers and manufacturing companies that are fighting for less asbestos litigation. The idea is that it is too easy for individuals to sue big companies for asbestos–related diseases and compensation. The group is asking that a standardized criterion be met before a person can file suit in West Virginia.
When a frivolous lawsuit occurs, the very people that need compensation are among the victims of the current system. The erroneous lawsuits clog up the system and take compensation away from victims who need it to survive. The group is moving for stricter screening prior to litigation, asking that each plaintiff much meet specific medical criteria to qualify. The system would also keep large companies from spending money, and possibly declaring bankruptcy, over cases that should not receive compensation. If a large company must declare bankruptcy, no compensation would be paid to victims depending on assistance, thus strengthening the need for stricter rules.
