One Stop Answer for Asbestos Problem

The amount of asbestos-related cases in the United States is on the rise. With so many different parties involved, a cure-all answer would be hard to find. There may be a middle road, though, for victims and companies alike.

The amount of asbestos-related lawsuits is on the rise, and, sadly enough, not all of them are valid. With the number of lawsuits and counter-suits, the courts have found themselves bogged down in the fight between victim, insurance agencies and businesses. The victims often wait years before their case is heard, sometimes not living to see their day in court. Civilian victims have the option of suing their employer that exposed them to asbestos; military personnel don’t have that option.

The answer to all these gray areas may lie in HR5851, a legislation that would dictate who can and cannot file and asbestos-related lawsuit. The only problem is that veterans afflicted with asbestos-related diseases will be left out of the decision. This is where the FAIR Act would step in; the national Act would create a trust fund for victims, which will react quickly to suits. The fund will be made of contributions from defendants and their insurers.
