Mandate Resolves Responsibility in Asbestos Case

A construction company in Missouri was warned that they had to investigate for asbestos, according to the city. The company is now under investigation for mishandling asbestos at a downtown plaza.

The site of a demolished house showed evidence of asbestos and got a Missouri construction company into a whole lot of trouble. The city advised the Missouri construction company that an asbestos inspection was needed prior to demolition, while the company rebuts that it was not their responsibility to inspect nearly 100 homes before the demolition occurred. The need for an inspection was further stressed last year in contracts between the city and the development company.

Kansas City’s largest urban redevelopment project was put on hold while the issue was being settled. The construction company states that they followed the city’s instructions for the project to the letter and had believed that the site would be inspected by a third party before the demolition took place. The construction company hired a third party to analyze abatement after the project was shut down on June 9th. Lawyers have now been called in, since it appears that trucks are still hauling away the potentially hazardous asbestos from the site. It has been established by the courts that responsibility for the inspections and abatement does fall on the construction company.
