Smoking Gun Found in Asbestos Case

General Motors has a supposed document that could bring Royal & Sunalliance to its knees in the year old case of producer against insurer. The memo supposedly would turn the case, with indications that it states an admission of liability.

A huge lawsuit involving one of the largest car manufacturers and their insurance company may be creeping to a close. GM stated this week that they have come across a memo from within Royal & Sunalliance that admits liability, a verifiable smoking gun in the case. The memo, originating from a former senior executive of R&S admits that the insurance company, and not GM, is responsible for claims in asbestos-related cases.

R&S argues that the handwritten memo was a record of a confidential conversation and should be inadmissible to the case. They went further to state that the memo was included in a box of more than 2,000 documents by accident, which has changed hands multiple times during the trial. At stake is a $1 billion lawsuit which is trying to establish who is responsible for paying insurance claims for those who worked for GM, but were insured by R&S and who later contracted mesothelioma.
