Michigan to Review Asbestos Laws

Litigation involving asbestos is coming under the Michigan radar this week. The call to government is a response to over 70 companies going out of business, costing the nation 60,000 jobs a year.

The call for reformation involving asbestos litigation follows an active year of lawsuits, bankrupted businesses and loss of jobs. The Bill presented by the Tort Reform Committee would specify when asbestos lawsuits could be filed. The proposal would assure that people have a physical impairment that can be attributed directly to asbestos or silica exposure. The Bill would also cap payout amounts for sufferers to three times the economic loss or $250,000 whichever is the greater.

The lawsuits are generally a result of asbestos exposure leading to a life long disease, including asbestosis, emphysema, lung cancer and mesothelioma. The diseases are often detected years after inhalation has started the process, a time when the conditions are untreatable. The Bill would make sure that all plaintiffs involved would meet certain criteria before filing, and would limit attorneys’ fees to 20% of the settlement. The Supreme Court of Michigan is also set to hear proposals on asbestos litigation, and the nation will be debating a Bill in Congress the middle of summer.
