Asbestos Removal Firm Gives Up Fight

A firm that removed asbestos from condominiums in Colorado has given up the fight to get paid. A New Mexican man's firm tried to sue the condo for payment, but gave when his budget ran out.

The North of Nell Condominium owners in downtown Aspen have won the fight against a New Mexico man whose firm had removed asbestos from the buildings. Though he says his company is still owed money for the work, he has run through too much money defending his suit. Morris Young, owner of Envirotech, admitted that the condo association has the ability to continue the fight with bigger lawyers and more money than he can supply.

Young had filed 39 liens against unit owners, each for more than $100,000, last October. The total bill of $4 million was for work done to the garage of the building, a common ownership area and liable to each unit owner. The firm had been paid about $86,000 prior to filing the lien; the dispute began after the company had already begun to remove the material. Young is still owed millions on the completed deal, which was done in order to satisfy state laws, but the company cannot afford to fight the bill any longer.
