An Ohio judge in Cook County has found a way to streamline the asbestos litigation in his docket. By sidelining cases that don’t involve victims that are sick, he can address the people that are in desperate need much faster than in other counties. Judge William Maddux decided five years ago that people involved in asbestos lawsuits should fall within a certain category. When a new case is brought in front of him in Cook County, Ohio, he scans the file to see if the litigation involves a sick or deceased victim of asbestos exposure. If not, the file gets put aside so that he can focus on people that need restitution immediately. Though the procedure may sound harsh, it has made Cook County a model of efficiency when it comes to asbestos litigation. Asbestos lawsuits, in particular those encompassing mesothelioma victims, can take years to settle. Since mesothelioma, a deadly form of lung cancer resulting from asbestos exposure, can be terminal at the time of detection, time is of the essence for victims of the debilitating disease. When asbestos particles are breathed into the lungs, they become stuck and keep the tissue from absorbing oxygen. The result is a mesothelioma, an illness that suffocates its victims until they die.
