NY Company Stops Removing Asbestos After Lawsuit

After pleading guilty to a felony charge last week, officials with a company that illegally removed asbestos from New York buildings will cease from any abatement projects they have and will no longer accept others.

After pleading guilty to the felony charge of conspiracy to violate the Clean Air and Clean Water Act, the company will no longer offer their services. The company, based in Elmira, was also charged with conspiracy to commit mail fraud. The company received a $100,000 fine from a US District judge, and was ordered to surrender all its licenses, as well as banning them from removing asbestos ever again.

A number of environmental health and safety laws were violated and the company failed to notify the EPA about work it was doing with asbestos. Prior services were completed on colleges, schools, hospitals, town halls and nursing homes. These areas were subject to asbestos being left behind, improper containment and incomplete paperwork. Even though company officials had pleaded guilty to creating false business records, they had been in business for over 20 years. The general manager was later sentenced to 18 months in federal prison due to the charges.
