An increase in the amount of asbestos-related lawsuits has one insurer group thinking that Michigan will reform its asbestos litigation. The legislation would focus on cutting down frivolous lawsuits.
The Michigan Legislature is thinking about reforming their litigation when it comes to asbestos-related claims, according to Property Casualty Insurers. The state has recently looked to the efforts of other states, including Florida, Georgia and Texas which have worked to cut down on the number of frivolous suits filed. Included is the protection of companies that do not produce asbestos from being sued, as well as the ability to focus on valid suits. The House and Senate of Michigan held hearings this week on the issues, with the Judiciary Committee and House Tort Reform hearing different Bills.
A reasonable medical standard for asbestos and silicon claims will be necessary by both Bills; they will also place no additional burden on mesothelioma victims, and will preserve the rights of claimants should they become ill. Each case can be tried on its own merit, not having to be part of a bundle of claims which can hide unimpaired claimants among those that are truly sick.
