Spouse Can Sue Over Woman’s Death

A judge ruled today that a man can sue over the death of his wife. The woman died from mesothelioma, a lung cancer associated with asbestos, after washing her husband’s tainted clothes.

New Jersey wife Eleanor Olivo never knew that doing laundry would kill her. But her husband’s asbestos-contaminated work clothing allegedly did just that. The man is now suing the property owner where he was exposed to asbestos-insulated pipes, and a judge said that he could continue with his suit. According to the judge, Exxon Mobile should have provided sanitation for the clothes that Eleanor washed. The unprotected work clothing is a responsibility of the company, and is a foreseeable risk to those that are in the home of the workers.

The Trenton man’s wife died in 2001 of mesothelioma, a lung cancer that is the result of repeated exposure to asbestos. The man worked with asbestos from 1947 to 1984, while the company had been aware of the affects of asbestos since 1937. Mesothelioma results from asbestos fibers working their way into the lining of the lungs, inhibiting the lining from absorbing oxygen. The tissues die, and results in the victims deaths years or decades, after exposure.
