Judge in Asbestos Case Must Pay

A federal jury decided that a judge in Texas will have to reimburse former clients in an asbestos case more than $100,000. The judge was accused of lying to clients about settlements in asbestos cases.

 

A federal judge decided a newly elected Dallas County judge would have to pay almost $130,000 to a family after they accused him of lying about their asbestos case. The Dallas judge, who was a trial lawyer and representing the family at the time, was leading a wrongful death lawsuit for the wife and daughters of a shipyard worker who had died due to mesothelioma. Mesothelioma, a deadly form of lung cancer, is attributed to asbestos exposure. The man had been exposed to asbestos for decades when he worked in the shipyards, and had passed away just months after being diagnosed with the disease.

            The lawyer had stated that all parties involved in the trial had settled, amounting to $2.5 million to the family. One of the defendants, an asbestos insulation manufacturer, in fact had not settled in the amount of $250,000, which held up the disbursement in the case. When the insulation company agreed to $215,000 as a settlement, they had already begun paperwork to file for bankruptcy. The family never received that payout, and held their lawyer liable, saying that he had lied to them.
