Payout Feels Remote For Victims

French firm’s bid to share responsibility could steal workers compensation. If all employers get together, the victims could be the ones to lose.

The House of Lords will be the stage for a landmark legal challenge starting next week, involving an attempt to limit payouts for those who suffer from mesothelioma, It is put forward that the overbearing costs of compensating victims of the disease could be apportioned between companies if the victim worked for more than one company. The deadly dust from the mines in the area have caused the lung cancer to spread to most of the mine workers in the area. A good portion of these workers were employed by various companies working in various mines.

If each of the companies that a victim worked for would contribute to the compensation that worker was given, the cost to each company would be less. But if the House of Lords rules in favor of the multi-company payout, and one of the companies declares bankruptcy, then the victim would be at a loss. After the benefits of the government are taken off, and the possibility of a portion being taken away by a company declaring bankruptcy, the payout could be discouraging to a victim.
