A judge in Ohio threw out an asbestos litigation case last week when it was found that the plaintiff’s lawyers doctored documents submitted to the court. The law firm may loose privileges to practice in Ohio, a main arena for asbestos cases.
An Ohio judge dismissed an asbestos litigation suit last week when it was discovered that the plaintiff’s lawyers had submitted fraudulent asbestos claim forms and lied to the court regarding their client. The law firm represented the estate of Harry Kananian, who died from mesothelioma, a form of cancer tied to asbestos exposure. The lawsuit was against Lorillard Tobacco, which makes Kent cigarettes; lawyers for the tobacco company found documents showing that Kananian’s lawyers had sued multiple companies for compensation, and then lied to the court about the suits.
Asbestos suits can take many forms, either as a result of one person affected by asbestos exposure or by many people that were exposed by the same source. Many times, the cases are for victims of mesothelioma, a form of cancer that is linked with breathing asbestos fibers into the lungs. Emphysema and asbestosis can also result from asbestos exposure, and each illness can take years to develop.
