Asbestos Suit Filed by Railroad Worker

A railroad worker of more than 40 years has filed suit that he was exposed to asbestos for almost the entire duration of his career. Filed in Kanawha Circuit court, the South Carolina case now has seven defendants listed.

The suit says that the plaintiff worked for the Chesapeake and Ohio Railway Company between 1951-1995. According to the suit, he was repeatedly exposed to asbestos dust and fibers while he worked as a laborer and crane operator. This exposure resulted in severe and permanent injuries and disabilities including mesothelioma. Seven other plaintiffs have joined the list of the eight-count suit. The case includes not only the owning railway company, CSX Transportation Inc., but their insurance companies as well.

The suit comes from the complaint that CSX did not supply a safe working environment, use proper safety equipment, warn it’s employees of potential danger and did not instruct them on safe handling of asbestos. The plaintiff further states that when the employer revealed that the material contained asbestos, the dangers were not made known, and the products made were not fit for use. A jury trial has been requested, with all the plaintiffs seeking compensatory and punitive damages.
