Judge Turns Down Asbestos Case

A Federal Court ruled that defunct W.R. Grace and Co. would not be held responsible for asbestos cases involving Zonolite insulation. Plaintiffs had tried to sue the company that once made the attic insulation.

People are more likely to die from riding a bicycle than from being around Zonolite insulation, according to a federal bankruptcy judge this week. Plaintiffs that were attempting to bring a new case against asbestos-plagued W.R. Grace and Co. were dismayed when the judge determined that the attic insulation, which does contain asbestos, is not a blatant health risk. The judge further stated that W.R. Grace, which mined and produced asbestos and asbestos-containing items, is a focal point for those seeking restitution for asbestos-related diseases.

Grace mined the dangerous material in Libby, Montana, a city famous for its asbestos-related diseases. The people of Libby have been involved in multiple lawsuits against the company, which ended up filing bankruptcy and closing down as a result of the settlements. Asbestos exposure can lead to many different types of respiratory illnesses, including asbestosis, emphysema and a type of cancer known as mesothelioma. At the worst point, one in every four residents in Libby had an asbestos-related disease.
