Workers Can Sue Judge Over Asbestos

The Massachusetts Supreme Court ruled this week that workers from a Cambridge courthouse can sue the Chief Justice over asbestos exposure. The ruling will allow the workers’ lawsuit to move forward.

Workers of the Edward J. Sullivan Courthouse in Cambridge scored a victory this week after the Massachusetts Supreme Court ruled that they could sue the Chief Justice over alleged asbestos exposure. The ruling was handed down that the Chief Justice has a responsibility to safeguard health of those who are in the courthouse while renovations are under way. The defending lawyers countered that there was no danger of asbestos exposure, and that the Chief Justice followed protocol during the work on the courthouse.

The Chief Justice had stated that no work involving asbestos would be carried out until the 800 employees of the courthouse could be relocated. It was found that in April, after this statement was made, that the Justice authorized replacing elevator cables, which can dislodge asbestos, before the employees were relocated. If asbestos is disturbed, breathing in particles of the material can lead to respiratory problems, including asbestosis, emphysema and mesothelioma, a form of aggressive lung cancer. The courthouse used 60 thousands pounds of asbestos when it was built in 1969.
